By accessing, using, or creating an account on BikeCircle ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our service.

2. Description of Service

BikeCircle provides a social networking platform that allows users to:

• Create and join cycling events and group rides
• Track and share workout data and cycling routes
• Connect with other cyclists in their area
• Share photos, videos, and experiences from rides
• Access cycling-related content and community discussions

3. User Accounts and Eligibility

Age Requirements: You must be at least 13 years old to use BikeCircle. Users between 13-17 must have parental or guardian consent and supervision.

Account Responsibility: You must provide accurate, complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Community Guidelines and Conduct

BikeCircle promotes a positive, inclusive cycling community. Users must:

• Treat all community members with respect and courtesy
• Share accurate information about routes, conditions, and events
• Respect private property and local laws during rides
• Follow safety guidelines and encourage safe cycling practices
• Report dangerous or inappropriate behavior

Prohibited Conduct includes:

• Harassment, bullying, or discriminatory behavior
• Sharing false route information or safety data
• Organizing or promoting illegal activities
• Spamming or excessive promotional content
• Impersonating other users or creating fake accounts
• Sharing inappropriate content (violence, explicit material, etc.)

5. Cycling Events and Group Rides

Event Organizer Responsibilities:

• Provide accurate route information and difficulty levels
• Clearly communicate safety requirements and conditions
• Ensure compliance with local laws and regulations
• Consider participant skill levels and safety
• Have appropriate insurance if organizing commercial events

Participant Responsibilities:

• Assess your own ability and fitness for each ride
• Use proper safety equipment (helmets, lights, etc.)
• Follow traffic laws and group riding etiquette
• Inform organizers of any medical conditions or limitations
• Participate at your own risk

6. User Content and Data

Your Content: You retain ownership of content you post (photos, routes, comments, etc.) but grant BikeCircle a license to display, distribute, and use this content within the platform.

Fitness and Location Data: BikeCircle may integrate with fitness tracking devices and apps. You control what data you share and can modify privacy settings at any time.

Route and Safety Information: When sharing routes or safety information, you warrant that the information is accurate to the best of your knowledge. BikeCircle is not responsible for route conditions or accuracy.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy details how we collect, use, and protect your information. Key points:

• Location data is only shared according to your privacy settings
• Fitness data integration requires explicit consent
• You can control who sees your rides and personal information
• We do not sell personal data to third parties

8. Safety and Risk Acknowledgment

BikeCircle encourages but cannot mandate safety practices. Users are solely responsible for:

• Using appropriate safety equipment
• Assessing weather and road conditions
• Maintaining their bicycle in safe working condition
• Following all applicable traffic laws
• Riding within their skill and fitness level

9. Intellectual Property

BikeCircle and its content are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy or reproduce platform features or design
• Use BikeCircle branding without permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

10. Third-Party Integrations

BikeCircle may integrate with third-party services (fitness apps, mapping services, payment processors). Your use of these services is subject to their respective terms and privacy policies. BikeCircle is not responsible for third-party service failures or data handling.

11. Account Suspension and Termination

Our Rights: We may suspend or terminate accounts for violations of these terms, illegal activity, or behavior harmful to the community. We will provide notice when possible and allow appeal for disputed actions.

Your Rights: You may delete your account at any time. Upon deletion, we will remove or anonymize your data according to our Privacy Policy, though some information may remain in backups for legal or safety reasons.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• BikeCircle provides the platform "as is" without warranties
• We are not liable for injuries, accidents, or damages during cycling activities
• Our liability is limited to the amount paid for services (if any) in the past 12 months
• We are not responsible for user-generated content or third-party actions

13. Dispute Resolution

Communication First: For disputes, please contact us at krishay.db@gmail.com. We commit to good-faith resolution efforts.

Arbitration: If direct resolution fails, disputes will be resolved through binding arbitration rather than court proceedings, except for small claims or intellectual property issues.

14. Geographic Restrictions

BikeCircle is based in the United States. Some features may not be available in all countries due to local laws or technical limitations. International users access the service at their own discretion.

15. Changes to Terms

We may update these terms to reflect service changes or legal requirements. Material changes will be communicated through:

• Email notification to active users
• In-app notification
• Website announcement with 30-day notice period

Continued use after changes indicates acceptance of new terms.

16. Governing Law

These terms are governed by the laws of California, United States. Any legal proceedings will be conducted in California state or federal courts.

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
